Representative Experience
William has a diverse litigation practice, representing small and large businesses, and individuals in a variety of litigation and administrative law matters, including contract disputes, debt collection, employment, real estate and bankruptcy matters. He represents clients in both federal and state courts.
He also advises both employers and employees on labor and employment issues and related matters, and represents a number of commercial landlords in lease matters and tenant disputes, including eviction and rent collection issues and tenant bankruptcies.
William represents owners, contractors and subcontractors in construction disputes, contract and lien claims tried in the courts and in arbitration. He has also represented developers, landowners and title insurance companies in real estate matters involving boundary and title disputes.
In addition, William works with insurance and real estate agents and appraisers when professional negligence claims are brought against them, and represents real estate agents in claims brought against them by the North Carolina Real Estate Commission.
He represents banks and other lenders in establishing receiverships in foreclosures, loan collection and bankruptcy matters, and has also represented businesses and individuals in property tax appeals.
Specific Matters
- Represents creditors in bankruptcies large and small, including Midway Airlines, Roses Department Store and Montgomery Wards
- Represented property owners in title and boundary disputes, involving claims and defenses of adverse possession for land valued at over $4 million
- Represented real estate agents in commission disputes up to $450,000
- Defended a general contractor in synthetic stucco claims
- Represents general construction, HVAC, electrical, flooring, hauling, moving and storage, masonry and crane contractors in lien claims and contract litigation
- Represents and advises General Parts, Inc. on litigation, bankruptcy and Uniform Commercial Code issues
- Represented a residential subdivision developer in a contract dispute with tract builders
- Represented a physician in terminating his relationship with HMO
- Represents a retirement home/assisted living facility operator in various litigation and bankruptcy matters
- Represent shopping center owners with properties in Wake, Durham, Wayne and Guilford Counties in various litigation matters
- Represents four major property brokerage/management companies in litigation matters
- Represented Brick Mason in large construction defect claim arbitration
- Represented a physician placement agency in a dispute with a revolving credit lender
- Represent clients in the timber and forest products industry in contract termination, warranty, property tax and bankruptcy matters
- Represented a major life insurance company in franchise and employment termination claims by agents
- Represented a carpet franchisor in a noncompete action against former employee
- Represented creditors in a bankruptcy in preference payment defense
- Represented plaintiffs in a personal injury and wrongful death action.
